Mineral Resources Law of the People's Republic of China
第一條 為了發(fā)展礦業(yè),加強(qiáng)礦產(chǎn)資源的勘查,開發(fā)利用和保護(hù)工作,保障社會(huì)主義現(xiàn)代化建設(shè)的當(dāng)前和長(zhǎng)遠(yuǎn)的需要,根據(jù)中華人民共和國(guó)憲法,特制定本法。
Article 1 This Law is enacted in accordance with the Constitution of the
People's Republic of China, with a view to developing the mining industry,
promoting the exploration, development, utilization and protection of mineral
resources and ensuring the present and long-term needs of the socialist
modernization programme.
第二條 在中華人民共和國(guó)領(lǐng)域及管轄海域勘查、開采礦產(chǎn)資源,必須遵守本法。
Article 2 This Law must be observed in exploring and mining mineral resources
within the territory of the People's Republic of China and the marine areas
under its jurisdiction.
第三條 礦產(chǎn)資源屬于國(guó)家所有,由國(guó)務(wù)院行使國(guó)家對(duì)礦產(chǎn)資源的所有權(quán)。地表或者地下的礦產(chǎn)資源的國(guó)家所有權(quán),不因其所依附的土地的所有權(quán)或者使用權(quán)的不同而改變。
Article 3 Mineral resources belong to the State. The rights of State ownership
in mineral resources is exercised by the State Council. State ownership of
mineral resources, either near the earth's surface or underground, shall not
change with the alteration of ownership or right to the use of the land which
the mineral resources are attached to.
國(guó)家保障礦產(chǎn)資源的合理開發(fā)利用。禁止任何組織或者個(gè)人用任何手段侵占或者破壞礦產(chǎn)資源。各級(jí)人民政府必須加強(qiáng)礦產(chǎn)資源的保護(hù)工作。
The State safeguards the rational development and utilization of mineral
resources. Seizing or damaging mineral resources by any means and by any
organization or individual shall be prohibited. People's governments at various
levels must make serious efforts to protect mineral resources.
勘查、開采礦產(chǎn)資源,必須依法分別申請(qǐng),經(jīng)批準(zhǔn)取得探礦權(quán)、采礦權(quán),并辦登記;但是,已經(jīng)依法申請(qǐng)取得采礦權(quán)的礦山企業(yè)在劃定的礦區(qū)范圍內(nèi)為本企業(yè)的生產(chǎn)而進(jìn)行的勘查除外。國(guó)家保護(hù)探礦權(quán)和采礦權(quán)不受侵犯,保障礦區(qū)和勘查作業(yè)區(qū)的生產(chǎn)秩序、工作秩序不受影響和破壞。
Anyone who wishes to explore or mine mineral resources shall separately make
an application according to law and shall register after obtaining the right of
exploration or mining upon approval, with the exception of the mining
enterprises that have, in accordance with law, applied for and obtained the
right of mining and are conducting exploration within the designated mining area
for the purpose of their own production. The State protects the right of
exploration and of mining from encroachment and protects the order of production
and other work in the mining and exploration areas from interference and
disruption.
從事礦產(chǎn)資源勘查和開采的,必須符合規(guī)定的資質(zhì)條件。
Anyone engaged in exploring and mining of mineral resources shall meet the
prescribed qualifications.
第四條 國(guó)家保障依法設(shè)立的礦山企業(yè)開采礦產(chǎn)資源的合法權(quán)益。
Article 4 The State protects the lawful rights and interests of mining
enterprises, established in accordance with law, in mining of mineral resources.
國(guó)有礦山企業(yè)是開采礦產(chǎn)資源的主體。國(guó)家保障國(guó)有礦業(yè)經(jīng)濟(jì)的鞏固和發(fā)展。
The State-owned mining enterprises are the mainstay in mining mineral
resources. The State guarantees the consolidation and expansion of State-owned
mining enterprises.
第五條 國(guó)家實(shí)行探礦權(quán)、采礦權(quán)有償取得的制度。但是,國(guó)家對(duì)探礦權(quán)、采礦權(quán)有償取得的費(fèi)用,可以根據(jù)不同情況規(guī)定予以減繳、免繳。具體辦法和實(shí)施步驟由國(guó)務(wù)院規(guī)定。
Article 5 The State practises a system wherein the exploration right and
mining right shall be obtained with compensation; however, the State may, in
light of specific conditions, prescribe reduction of or exemption from the
compensation for acquiring the exploration right and mining right. Specific
measures and implementation procedures shall be formulated by the State Council.
開采礦產(chǎn)資源,必須按照國(guó)家有關(guān)規(guī)定繳納資源稅和資源補(bǔ)償費(fèi)。
Anyone who mines mineral resources must pay resource tax and resource
compensation in accordance with relevant regulations of the State.
第六條 除按下列規(guī)定可以轉(zhuǎn)讓外,探礦權(quán)、采礦權(quán)不得轉(zhuǎn)讓:
Article 6 Exploration right and mining right shall not be transferred except
for the transfers made according to the following provisions:
(一)探礦權(quán)人有權(quán)在劃定的勘查作業(yè)區(qū)內(nèi)進(jìn)行規(guī)定的勘查作業(yè),有權(quán)優(yōu)先取得勘查作業(yè)區(qū)內(nèi)礦產(chǎn)資源的采礦權(quán)。探礦權(quán)人在完成規(guī)定的最低勘查投入后,經(jīng)依法批準(zhǔn),可以將探礦權(quán)轉(zhuǎn)讓他人。
(1) The exploration licensees shall have the right to carry out specified
explorations within the designated exploration areas and have the priority to
obtain the right to mine the mineral resources in the exploration areas. The
exploration licensees, after fulfilling the specified minimum input to
exploration and obtaining approval in accordance with law, may transfer the
exploration right to another.
(二)已取得采礦權(quán)的礦山企業(yè),因企業(yè)合并、分立,與他人合資、合作經(jīng)營(yíng),或者因企業(yè)資產(chǎn)出售以及有其他變更企業(yè)資產(chǎn)產(chǎn)權(quán)的情形而需要變更采礦權(quán)主體的,經(jīng)依法批準(zhǔn)可以將采礦權(quán)轉(zhuǎn)讓他人采礦。
(2) A mining enterprise that has obtained the mining right but needs to change
the subject of the mining right, because of merger, division, forming of an
equity joint venture or contractual joint venture, sale of its assets, or change
of ownership of its assets in other manners, may transfer its mining right to
another, subject to approval in accordance with law.
前款規(guī)定的具體辦法和實(shí)施步驟由國(guó)務(wù)院規(guī)定。
The specific measures and implementation procedures concerning the provisions
in the preceding paragraph shall be stipulated by the State Council.
禁止將探礦權(quán)、采礦權(quán)倒賣牟利。
Profiteering in exploration right or mining right shall be prohibited.
第七條 國(guó)家對(duì)礦產(chǎn)資源的勘查、開發(fā)實(shí)行統(tǒng)一規(guī)劃、合理布局、綜合勘查、合理開采和綜合利用的方針。
Article 7 With regard to the exploration and development of mineral resources,
the State applies the principles of unified planning, rational geographical
distribution, multi-purpose exploration, rational mining and multi-purpose
utilization.
第八條 國(guó)家鼓勵(lì)礦產(chǎn)資源勘查、開發(fā)的科學(xué)技術(shù)研究,推廣先進(jìn)技術(shù),提高礦產(chǎn)資源勘查、開發(fā)的科學(xué)技術(shù)水平。
Article 8 The State encourages scientific and technological research on the
exploration and development of mineral resources, promotes advanced technology
so as to raise the scientific and technological level of mineral exploration and
development.
第九條 在勘查、開發(fā)、保護(hù)礦產(chǎn)資源和進(jìn)行科學(xué)技術(shù)研究等方面成績(jī)顯著的單位和個(gè)人,由各級(jí)人民政府給予獎(jiǎng)勵(lì)。
Article 9 Any organization or individual that has achieved outstanding
successes in the exploration, development and protection of mineral resources
and in scientific and technological research shall be awarded by relevant
people's government.
第十條 國(guó)家在民族自治地方開采礦產(chǎn)資源,應(yīng)當(dāng)照顧民族自治地方的利益,作出有利于民族自治地方經(jīng)濟(jì)建設(shè)的安排,照顧當(dāng)?shù)厣贁?shù)民族群眾的生產(chǎn)和生活。
Article 10 In mining mineral resources in national autonomous areas, the State
should give consideration to the interests of those areas and make arrangements
favourable to the areas' economic development and to the production and
well-being of the local minority nationalities.
民族自治地方的自治機(jī)關(guān)根據(jù)法律規(guī)定和國(guó)家的統(tǒng)一規(guī)劃,對(duì)可以由本地方開發(fā)的礦產(chǎn)資源,優(yōu)先合理開發(fā)利用。
Self-government organs in national autonomous areas shall, in accordance with
legal provisions and unified national plans, have the priority to develop and
utilize in a rational manner the mineral resources that may be developed by the
local authorities.
第十一條 國(guó)務(wù)院地質(zhì)礦產(chǎn)主管部門主管全國(guó)礦產(chǎn)資源勘查、開采的監(jiān)督管理工作。國(guó)務(wù)院有關(guān)主管部門協(xié)助國(guó)務(wù)院地質(zhì)礦產(chǎn)主管部門進(jìn)行礦產(chǎn)資源勘查、開采的監(jiān)督管理工作。
Article 11 The department in charge of geology and mineral resources under the
State Council shall be responsible for supervision and administration of the
exploration and mining of the mineral resources throughout the country. Other
relevant competent departments under the State Council shall assist the
department in charge of geology and mineral resources under the State Council in
supervising and administering the exploration and mining of the mineral
resources.
省、自治區(qū)、直轄市人民政府地質(zhì)礦產(chǎn)主管部門主管本行政區(qū)域內(nèi)礦產(chǎn)資源勘查、開采的監(jiān)督管理工作。省、自治區(qū)、直轄市人民政府有關(guān)主管部門協(xié)助同級(jí)地質(zhì)礦產(chǎn)主管部門進(jìn)行礦產(chǎn)資源勘查、開采的監(jiān)督管理工作。
The departments in charge of geology and mineral resources under the people's
governments of provinces, autonomous regions and municipalities directly under
the Central Government shall be in charge of supervision and administration of
the exploration and mining of the mineral resources within their respective
administrative areas. Other relevant departments under the people's governments
of provinces, autonomous regions and municipalities directly under the Central
Government shall assist the departments in charge of geology and mineral
resources at the corresponding levels in supervising and administering the
exploration and mining of the mineral resources.
第二章 礦產(chǎn)資源勘查的登記和開采的審批
CHAPTER II REGISTRATION FOR EXPLORATION OF MINERAL RESOURCES AND EXAMINATION
AND APPROVAL OF MINING
第十二條
國(guó)家對(duì)礦產(chǎn)資源勘查實(shí)行統(tǒng)一的區(qū)塊登記管理制度。礦產(chǎn)資源勘查登記工作,由國(guó)務(wù)院地質(zhì)礦產(chǎn)主管部門負(fù)責(zé);特定礦種的礦產(chǎn)資源勘查登記工作,可以由國(guó)務(wù)院授權(quán)有關(guān)主管部門負(fù)責(zé)。礦產(chǎn)資源勘查區(qū)塊登記管理辦法由國(guó)務(wù)院制定。
Article 12 The State practises a unified regional registration system for
exploration of mineral resources. The department in charge of geology and
mineral resources under the State Council shall be responsible for the
registration of exploration of mineral resources. The State Council may
authorize other relevant competent departments to handle the registration of
exploration of specified minerals. Measures for regional registration of
exploration of mineral resources shall be formulated by the State Council.
第十三條
國(guó)務(wù)院礦產(chǎn)儲(chǔ)量審批機(jī)構(gòu)或者省、自治區(qū)、直轄市礦產(chǎn)儲(chǔ)量審批機(jī)構(gòu)負(fù)責(zé)審查批準(zhǔn)供礦山建設(shè)設(shè)計(jì)使用的勘探報(bào)告,并在規(guī)定的期限內(nèi)批復(fù)報(bào)送單位??碧綀?bào)告未經(jīng)批準(zhǔn),不得作為礦山建設(shè)設(shè)計(jì)的依據(jù)。
Article 13 The department in charge of examination and approval of mineral
reserves under the State Council or departments in charge of examination and
approval of mineral reserves of provinces, autonomous regions and municipalities
directly under the Central Government shall be responsible for the examination
and approval of the prospecting reports to be used for mining construction
designing and shall, within the prescribed time limit, give official replies to
the units that submitted the reports. Unless it is approved, a prospecting
report may not be used as the basis for mining construction designing.
第十四條 礦產(chǎn)資源勘查成果檔案資料和各類礦產(chǎn)儲(chǔ)量的統(tǒng)計(jì)資料,實(shí)行統(tǒng)一的管理制度,按照國(guó)務(wù)院規(guī)定匯交或者填報(bào)。
Article 14 Archives of mineral exploration results and statistical data of
reserves of various minerals shall be subject to unified management, and shall
be collected or compiled for submission in accordance with the regulations of
the State Council.
第十五條
設(shè)立礦山企業(yè),必須符合國(guó)家規(guī)定的資質(zhì)條件,并依照法律和國(guó)家有關(guān)規(guī)定,由審批機(jī)關(guān)對(duì)其礦區(qū)范圍、礦山設(shè)計(jì)或者開采方案、生產(chǎn)技術(shù)條件、安全措施和環(huán)境保護(hù)措施等進(jìn)行審查;審查合格的,方予批準(zhǔn)。
Article 15 Anyone who wishes to establish a mining enterprise must meet the
qualifications prescribed by the State, and the department in charge of
examination and approval shall, in accordance with law and relevant State
regulations examine the enterprise's mining area, its mining design or mining
plan, production and technological conditions and safety and environmental
protection measures. Only those that pass the examination shall be granted
approval.
第十六條 開采下列礦產(chǎn)資源的,由國(guó)務(wù)院地質(zhì)礦產(chǎn)主管部門審批,并頒發(fā)采礦許可證:
Article 16 Anyone who wishes to mine the following mineral resources shall be
subject to examination and approval by the department in charge of geology and
mineral resources under the State Council, which shall also issue a mining
license:
(一)國(guó)家規(guī)劃礦區(qū)和對(duì)國(guó)民經(jīng)濟(jì)具有重要價(jià)值的礦區(qū)的礦產(chǎn)資源;
(1) those within the mining areas embraced in State plans or within the mining
areas which are of great value to the national economy;
(二)前項(xiàng)規(guī)定區(qū)域以外可供開采的礦產(chǎn)儲(chǔ)量規(guī)模在大型以上的礦產(chǎn)資源;
(2) those outside the areas mentioned in the preceding sub-paragraph, and
where the minerable mineral reserves are at least of a large quantity;
(三)國(guó)家規(guī)定實(shí)行保護(hù)性開采的特定礦種;
(3) specified minerals of which protective mining is prescribed by the State;
(四)領(lǐng)海及中國(guó)管轄的其他海域的礦產(chǎn)資源;
(4) those in the territorial seas and other sea areas under China's
jurisdiction; and
(五)國(guó)務(wù)院規(guī)定的其他礦產(chǎn)資源。
(5) other mineral resources as prescribed by the State Council.
開采石油、天然氣、放射性礦產(chǎn)等特定礦種的,可以由國(guó)務(wù)院授權(quán)的有關(guān)主管部門審批,并頒發(fā)采礦許可證。
The competent departments authorized by the State Council may conduct
examination of and grant approval to mining of such specified minerals as oil,
natural gas, radioactive minerals and issue mining licenses.
開采第一款、第二款規(guī)定以外的礦產(chǎn)資源,其可供開采的礦產(chǎn)的儲(chǔ)量規(guī)模為中型的,由省、自治區(qū)、直轄市人民政府地質(zhì)礦產(chǎn)主管部門審批和頒發(fā)采礦許可證。
The mining of mineral resources that are not covered by the provisions of
paragraphs 1 and 2 and the mineable reserves of which are of medium quantity
shall be subject to examination and approval by the departments in charge of
geology and mineral resources under the people's governments of provinces,
autonomous regions and municipalities directly under the Central Government,
which shall issue mining licenses.
開采第一款、第二款和第三款規(guī)定以外的礦產(chǎn)資源的管理辦法,由省、自治區(qū)、直轄市人民代表大會(huì)常務(wù)委員會(huì)依法制定。
Measures for the administration of the mining of mineral resources not covered
by the provisions of paragraphs 1, 2 and 3 shall be formulated by the standing
committees of the people's congresses of provinces, autonomous regions and
municipalities directly under the Central Government according to law.
依照第三款、第四款的規(guī)定審批和頒發(fā)采礦許可證的、由省、自治區(qū)、直轄市人民政府地質(zhì)礦產(chǎn)主管部門匯總向國(guó)務(wù)院地質(zhì)礦產(chǎn)主管部門備案。
Where examination and approval are conducted and mining licenses are issued
under the provisions of paragraph 3 and paragraph 4, the departments in charge
of geology and mineral resources under the people's governments of provinces,
autonomous regions and municipalities directly under the Central Government
shall collect the cases and submit them to the department in charge of geology
and mineral resources under the State Council for the record.
礦產(chǎn)儲(chǔ)量規(guī)模的大型、中型的劃分標(biāo)準(zhǔn),由國(guó)務(wù)院礦產(chǎn)儲(chǔ)量審批機(jī)構(gòu)規(guī)定。
The standards for large and medium quantities of mineral reserves shall be
formulated by the department in charge of examination and approval of mineral
reserves under the State Council.
第十七條
國(guó)家對(duì)國(guó)家規(guī)劃礦區(qū)、對(duì)國(guó)民經(jīng)濟(jì)具有重要價(jià)值的礦區(qū)和國(guó)家規(guī)定實(shí)行保護(hù)性開采的特定礦種,實(shí)行有計(jì)劃的開采;未經(jīng)國(guó)務(wù)院有關(guān)主管部門批準(zhǔn),任何單位和個(gè)人不得開采。
Article 17 The State institutes a policy of planned mining with regard to
mining areas that are embraced in State plans, mining areas that are of great
value to the national economy and the specified minerals of which protective
mining is prescribed by the State. Unless approved by the competent department
under the State Council, no unit or individual may carry out such mining.
第十八條 國(guó)家規(guī)劃礦區(qū)的范圍、對(duì)國(guó)民經(jīng)濟(jì)具有重要價(jià)值的礦區(qū)的范圍、礦山企業(yè)礦區(qū)的范圍依法劃定后,由劃定礦區(qū)范圍的主管機(jī)關(guān)通知有關(guān)縣級(jí)人民政府予以公告。
Article 18 After the limits for the mining areas that are embraced in State
plans, the limits for mining areas that are of great value to the national
economy, and the limits for mining areas of mining enterprises have been defined
according to law, the competent departments that defined the limits of the
mining areas shall notify the relevant people's governments at the county level
to announce them.
礦山企業(yè)變更礦區(qū)范圍,必須報(bào)請(qǐng)?jiān)瓕徟鷻C(jī)關(guān)批準(zhǔn),并報(bào)請(qǐng)?jiān)C發(fā)采礦許可證的機(jī)關(guān)重新核發(fā)采礦許可證。
If a mining enterprise wishes to change the limits of its mining area, it must
apply to the department that examined or approved of the limits for approval and
apply to the department that issued the mining license for reissue of a mining
license after verification.
第十九條 地方各級(jí)人民政府應(yīng)當(dāng)采取措施,維護(hù)本行政區(qū)域內(nèi)的國(guó)有礦山企業(yè)和其他礦山企業(yè)礦區(qū)范圍內(nèi)的正常秩序。
Article 19 The local people's governments at various levels shall adopt
measures to maintain normal order in the mining areas of State-owned mining
enterprises and other mining enterprises within their respective administrative
areas.
禁止任何單位和個(gè)人進(jìn)入他人依法設(shè)立的國(guó)有礦山企業(yè)和其他礦山企業(yè)礦區(qū)范圍內(nèi)采礦。
No unit or individual may enter and carry out mining in the mining areas of a
State-owned mining enterprise or other mining enterprise that was established
according to law.
第二十條 非經(jīng)國(guó)務(wù)院授權(quán)的有關(guān)主管部門同意,不得在下列地區(qū)開采礦產(chǎn)資源:
Article 20 Unless approved by the competent departments authorized by the
State Council, no one may mine mineral resources in the following places:
(一)港口、機(jī)場(chǎng)、國(guó)防工程設(shè)施圈定地區(qū)以內(nèi);
(1) within delimited areas of harbours, airports and national defence projects
or installations;
(二)重要工業(yè)區(qū)、大型水利工程設(shè)施、城鎮(zhèn)市政工程設(shè)施附近一定距離以內(nèi);
(2) within a certain distance from important industrial districts, largescale
water conservancy works or municipal engineering installations of cities and
towns;
(三)鐵路、重要公路兩側(cè)一定距離以內(nèi);
(3) within certain limits on both sides of railways and important highways;
(四)重要河流、堤壩兩側(cè)一定距離以內(nèi);
(4) within certain limits on both sides of important rivers and embankments;
(五)國(guó)家劃定的自然保護(hù)區(qū)、重要風(fēng)景區(qū),國(guó)家重點(diǎn)保護(hù)的不能移動(dòng)的歷史文物和名勝古跡所在地;
(5) nature reserves and important scenic spots designated by the State, major
sites of immovable historical relics and places of historical interest and
scenic beauty that are under State protection; and
(六)國(guó)家規(guī)定不得開采礦產(chǎn)資源的其他地區(qū)。
(6) other areas where mineral mining is prohibited by the State.
第二十一條 關(guān)閉礦山,必須提出礦山閉坑報(bào)告及有關(guān)采掘工程、不安全隱患、土地復(fù)墾利用、環(huán)境保護(hù)的資料,并按照國(guó)家規(guī)定報(bào)請(qǐng)審查批準(zhǔn)。
Article 21 If a mine is to be closed down, a report must be prepared with
information about the mining operations, hidden dangers, land reclamation and
utilization, and environmental protection, and an application for examination
and approval must be filed in accordance with relevant State regulations.
第二十二條 勘查、開采礦產(chǎn)資源時(shí),發(fā)現(xiàn)具有重大科學(xué)文化價(jià)值的罕見地質(zhì)現(xiàn)象以及文化古跡,應(yīng)當(dāng)加以保護(hù)并及時(shí)報(bào)告有關(guān)部門。
Article 22 If, in the course of mineral exploration or mining, rare geological
phenomena or ancient cultural remains of significant scientific and cultural
value are discovered, they shall be protected and reported immediately to the
relevant departments.
第三章 礦產(chǎn)資源的勘查
CHAPTER III EXPLORATION OF MINERAL RESOURCES
第二十三條 區(qū)域地質(zhì)調(diào)查按照國(guó)家統(tǒng)一規(guī)劃進(jìn)行。區(qū)域地質(zhì)調(diào)查的報(bào)告和圖件按照國(guó)家規(guī)定驗(yàn)收,提供有關(guān)部門使用。
Article 23 Regional geological surveys shall be carried out in accordance with
the unified State plan. Reports on regional geological surveys and the appended
maps and other data shall be examined for acceptance in accordance with State
regulations and then provided to relevant departments for use.
第二十四條 礦產(chǎn)資源普查在完成主要礦種普查任務(wù)的同時(shí),應(yīng)當(dāng)對(duì)工作區(qū)內(nèi)包括共生或者伴生礦產(chǎn)的成礦地質(zhì)條件和礦床工業(yè)遠(yuǎn)景作出初步綜合評(píng)價(jià)。
Article 24 In conducting a general survey of mineral resources, after
completing survey of the major minerals, a preliminary comprehensive assessment
shall be made of the minerogenetic conditions involving all paragenetic or
associated minerals and of the industrial perspective of the mineral deposits in
the area being surveyed.
第二十五條
礦床勘探必須對(duì)礦區(qū)內(nèi)具有工業(yè)價(jià)值的共生和伴生礦產(chǎn)進(jìn)行綜合評(píng)價(jià),并計(jì)算其儲(chǔ)量。未作綜合評(píng)價(jià)的勘探報(bào)告不予批準(zhǔn)。但是,國(guó)務(wù)院計(jì)劃部門另有規(guī)定的礦床勘探項(xiàng)目除外。
Article 25 In prospecting for mineral deposits, a comprehensive assessment of
the paragenetic and associated minerals of commercial value within the mining
area must be made and their reserves calculated. Any prospecting report without
such comprehensive assessment shall not be approved. However, an exception shall
be made of those mineral deposits for which the planning department under the
State Council has made other stipulations.

Article 26 In conducting general surveys and prospecting for special fragile
nonmetallic minerals, fluid minerals, combustible, explosive and soluble
minerals and minerals containing radioactive elements, methods prescribed by the
relevant departments under the people's governments at or above the provincial
level must be used, and necessary technical installations must be provided and
safety measures applied.
第二十七條 礦產(chǎn)資源勘查的原始地質(zhì)編錄和圖件,巖礦心、測(cè)試樣品和其他實(shí)物標(biāo)本資料,各種勘查標(biāo)志,應(yīng)當(dāng)按照有關(guān)規(guī)定保護(hù)和保存。
Article 27 The original geological record, maps and other data of mineral
exploration, rock cores, test samples, specimens of other material objects, and
various exploration marks shall be protected and preserved in accordance with
relevant regulations.
第二十八條 礦床勘探報(bào)告及其他有價(jià)值的勘查資料,按照國(guó)務(wù)院規(guī)定實(shí)行有償使用。
Article 28 Prospecting reports on mineral deposits and other valuable
exploration data shall be provided for use with compensation in accordance with
the regulations of the State Council.
第四章 礦產(chǎn)資源的開采
CHAPTER IV MINING OF MINERAL RESOURCES
第二十九條 開采礦產(chǎn)資源,必須采取合理的開采順序、開采方法和選礦工藝。礦山企業(yè)的一采回采率、采礦貧化率和選礦回收率應(yīng)當(dāng)達(dá)到設(shè)計(jì)要求。
Article 29 In mining mineral resources, a mining enterprise must adopt
rational mining sequence and methods and proper ore-dressing technique. It shall
see to it that the recovery rate and impoverishment rate in mining and recovery
rate in ore-dressing meet the design requirements.
第三十條
在開采主要礦產(chǎn)的同時(shí),對(duì)具有工業(yè)價(jià)值的共生和伴生礦產(chǎn)應(yīng)當(dāng)統(tǒng)一規(guī)劃,綜合開采,綜合利用,防止浪費(fèi);對(duì)暫時(shí)不能綜合開采或者必須同時(shí)采出而暫時(shí)還不能綜合利用的礦產(chǎn)以及含有有用組分的尾礦,應(yīng)當(dāng)采取有效的保護(hù)措施,防止損失破壞。
Article 30 While mining major minerals, a mining enterprise shall, in
accordance with a unified plan, carry out comprehensive mining and utilization
of paragenetic and associated minerals that are of industrial value, so as to
avoid waste. It shall adopt effective protective measures to avoid loss and
damage to ores that cannot be mined in a comprehensive way or that must be mined
simultaneously but cannot be comprehensively utilized for the time being, and to
tailings containing useful components.
第三十一條 開采礦產(chǎn)資源,必須遵守國(guó)家勞動(dòng)安全衛(wèi)生規(guī)定,具備保障安全生產(chǎn)的必要條件。
Article 31 In mining mineral resources, a mining enterprise or individual must
abide by State regulations regarding labour, safety and health and have the
necessary conditions to ensure safety in production.
第三十二條 開采礦產(chǎn)資源,必須遵守有關(guān)環(huán)境保護(hù)的法律規(guī)定,防止污染環(huán)境。
Article 32 In mining mineral resources, a mining enterprise or individual must
observe the legal provisions on environmental protection to prevent pollution of
the environment.
開采礦產(chǎn)資源,應(yīng)當(dāng)節(jié)約用電。耕地、草原、林地因采礦受到破壞的,礦山企業(yè)應(yīng)當(dāng)因地制宜地采取復(fù)墾利用、植樹種草或者其他利用措施。
In mining mineral resources, a mining enterprise or individual must economize
on the use of land. In cases cultivated land, grassland or forest land is
damaged due to mining, the mining enterprise concerned shall take measures to
utilize the land affected, such as by reclamation, tree and grass planting, as
appropriate to the local conditions.
開采礦產(chǎn)資源給他人生產(chǎn)、生活造成損失的,應(yīng)當(dāng)負(fù)責(zé)賠償,并采取必要的補(bǔ)救措施。
Anyone who, in mining mineral resources, causes losses to the production and
well-being of other persons shall be liable for compensation and shall adopt
necessary remedial measures.
第三十三條
在建設(shè)鐵路、工廠、水庫(kù)、輸油管道、輸電線路和各種大型建設(shè)物或者建筑群之前,建設(shè)單位必須向所在省、自治區(qū)、直轄市地質(zhì)礦產(chǎn)主管部門了解擬建工程所在地區(qū)的礦產(chǎn)資源分布和開采情況。非經(jīng)國(guó)務(wù)院授權(quán)的部門批準(zhǔn),不得壓覆重要礦床。
Article 33 Before the construction of railways, factories, reservoirs, oil
pipelines, transmission lines and various large structures or architectural
complexes, the units responsible for the construction must obtain information
from the departments in charge of geology and mineral resources under the local
people's governments of provinces, autonomous regions, or municipalities
directly under the Central government about the geographical distribution and
mining of the mineral resources in the areas where the construction projects are
to be built. Those projects shall not be constructed over important mineral
deposits unless approved by departments authorized by the State Council.
第三十四條 國(guó)務(wù)院規(guī)定由指定的單位統(tǒng)一收購(gòu)的礦產(chǎn)品,任何其他單位或者個(gè)人不得收購(gòu);開采者不得向非指定單位銷售。
Article 34 Mineral products to be purchased exclusively by designated units,
as prescribed by the State Council, may not be purchased by any other units or
individuals; mining enterprises and individuals shall not sell their products to
non-designated units.
第五章 集體礦山企業(yè)和個(gè)體采礦
CHAPTER V COLLECTIVELY-OWNED MINING ENTERPRISES AND PRIVATELY-OWNED
第三十五條
國(guó)家對(duì)集體礦山企業(yè)和個(gè)體采礦實(shí)行積極扶持、合理規(guī)劃、正確引導(dǎo)、加強(qiáng)管理的方針,鼓勵(lì)集體礦山企業(yè)開采國(guó)家指定范圍內(nèi)的礦產(chǎn)資源,允許個(gè)人采挖零星分散資源和只能用作普通建筑材料的砂、石、粘土以及為生活自用采挖少量礦產(chǎn)。
Article 35 The State applies the principles of vigorous support, rational
planning, correct guidance and effective administration with regard to
collectively-owned mining enterprises and privately-owned mining undertakings.
It encourages collectively-owned mining enterprises to mine mineral resources
within the areas designated by the State, and permits individuals to mine
scattered and dispersed mineral resources, as well as sand, stone and clay that
can only be used as ordinary building materials, and small amounts of minerals
for their own use in daily life.
礦產(chǎn)儲(chǔ)量規(guī)模適宜由礦山企業(yè)開采的礦產(chǎn)資源、國(guó)家規(guī)定實(shí)行保護(hù)性開采的特定礦種和國(guó)家規(guī)定禁止個(gè)人開采的其他礦產(chǎn)資源,個(gè)人不得開采。
Mineral resources that are suited to mining by mining enterprises in terms of
the quantity of reserves, specified minerals of which protective mining is
prescribed by the State, and other mineral resources of which mining by
individuals is prohibited by the State shall not be mined by individuals.
國(guó)家指導(dǎo)、幫助集體礦山企業(yè)和個(gè)體采礦不斷提高技術(shù)水平、資源利用率和經(jīng)濟(jì)效益。
The State provides guidance and assistance to collectively-owned mining
enterprises and privately-owned mining undertakings in unceasingly raising their
technical level and in increasing utilization rate of the mineral resources and
the economic results.
地質(zhì)礦產(chǎn)主管部門、地質(zhì)工作單位和國(guó)有礦山企業(yè)應(yīng)當(dāng)按照積極支持,有償互惠的原則向集體礦山企業(yè)和個(gè)體采礦提供地質(zhì)資料和技術(shù)服務(wù)。
Departments in charge of geology and mineral resources, geological units and
State-owned mining enterprises shall, on the principles of vigorous support and
mutual benefit, provide, with compensation, geological data and technical
services to collectively-owned mining enterprises and privately-owned mining
undertakings.
第三十六條
國(guó)務(wù)院和國(guó)務(wù)院有關(guān)主管部門批準(zhǔn)開辦礦山企業(yè)礦區(qū)范圍內(nèi)已有的集體礦山企業(yè),應(yīng)當(dāng)關(guān)閉或者到指定的其他地點(diǎn)開采,由礦山建設(shè)單位給予合理的補(bǔ)償,并妥善安置群眾生活;也可以按照該礦山企業(yè)的統(tǒng)籌安排,實(shí)行聯(lián)合經(jīng)營(yíng)。
Article 36 Existing collectively-owned mining enterprises, located within the
mining area of a mining enterprise to be established with the approval of the
State Council or the relevant competent departments under the State Council,
shall be closed down or shall conduct mining in other designated areas. The unit
that undertakes to open the mine shall give rational compensation to the said
collectively-owned mining enterprises and make appropriate arrangements for the
masses involved. Or else, according to its overall arrangement, the mining
enterprise may also enter into joint operation with the said collectively-owned
mining enterprises.
第三十七條 集體礦山企業(yè)和個(gè)體采礦應(yīng)當(dāng)提高技術(shù)水平,提高礦產(chǎn)資源回收率。禁止亂挖濫采,破壞礦產(chǎn)資源。
Article 37 Collectively-owned mining enterprises and privately-owned mining
undertakings shall raise their technical level and increase the recovery rate of
the mineral resources. Unauthorized and wasteful mining, which is destructive to
mineral resources, shall be prohibited.
集體礦山企業(yè)必須測(cè)繪井上、井下工程對(duì)照?qǐng)D。
Collectively-owned mining enterprises must survey and draw maps showing the
correlation between surface and underground workings.
第三十八條 縣級(jí)以上人民政府應(yīng)當(dāng)指導(dǎo)、幫助集體礦山企業(yè)和個(gè)體采礦進(jìn)行技術(shù)改造、改善經(jīng)營(yíng)管理,加強(qiáng)安全生產(chǎn)。
Article 38 People's governments at or above the county level shall provide
guidance and assistance to collectively-owned mining enterprises and
privately-owned mining undertakings in carrying out technological updating,
improving business management and ensuring safety in production.
第三十九條
違反本法規(guī)定,未取得采礦許可證擅自采礦的,擅自進(jìn)入國(guó)家規(guī)劃礦區(qū)、對(duì)國(guó)民經(jīng)濟(jì)具有重要價(jià)值的礦區(qū)范圍采礦的,擅自開采國(guó)家規(guī)定實(shí)行保護(hù)性開采的特定礦種的,責(zé)令停止開采、賠償損失,沒(méi)收采出的礦產(chǎn)產(chǎn)品和違法所得,可以并處罰款;拒不停止開采,造成礦產(chǎn)資源破壞的,依照刑法第一百五十六條的規(guī)定對(duì)直接責(zé)任人員追究刑事責(zé)任。
Article 39 If a person, in violation of the provisions of this Law, mines
without a mining license, enters and mines without authorization in a mining
area that is embraced in State plan or a mining area that is of great value to
the development of the national economy or mines without authorization specified
minerals of which protective mining is prescribed by the State, he shall be
ordered to stop mining, compensate for the losses caused, and his mineral
products and unlawful proceeds shall be confiscated, and he may also be fined.
If he refuses to stop mining and thus causes damage to the mineral resources,
the persons who are directly responsible shall be investigated for criminal
responsibility in accordance with the provisions of Article 156 of the Criminal
Law.
單位和個(gè)人進(jìn)入他人依法設(shè)立的國(guó)有礦山企業(yè)和其他礦山企業(yè)礦區(qū)范圍內(nèi)采礦的,依照前款規(guī)定處罰。
Any units or individuals who enter and mine in the mining areas of State-owned
mining enterprises and other mining enterprises established by others in
accordance with law shall be punished in accordance with the provisions of the
preceding paragraph.
第四十條
超越批準(zhǔn)的礦山范圍采礦的,責(zé)令退回本礦區(qū)范圍內(nèi)開采、賠償損失,沒(méi)收越界開采的礦產(chǎn)品和違法所得,可以并處罰款;拒不退回本礦區(qū)范圍內(nèi)開采,造成礦產(chǎn)資源破壞的,吊銷采礦許可證,依照刑法第一百五十六條的規(guī)定對(duì)直接責(zé)任人員追究刑事責(zé)任。
Article 40 If a person mines beyond the approved limits of his mining area, he
shall be ordered to return to and mine in his own area and compensate for the
losses caused, and the mineral products extracted outside his area and his
unlawful proceeds shall be confiscated, and he may also be fined. If he refuses
to return to his own mining area and causes damage to the mineral resources, his
mining license shall be revoked and the persons directly responsible shall be
investigated for criminal responsibility in accordance with the provisions of
Article 156 of the Criminal Law.
第四十一條
盜竊、搶奪礦山企業(yè)和勘查單位的礦產(chǎn)品和其他財(cái)物的,破壞采礦、勘查設(shè)施的,擾亂礦區(qū)和勘查作業(yè)區(qū)的生產(chǎn)秩序、工作秩序的,分別依照刑法有關(guān)規(guī)定追究刑事責(zé)任;情節(jié)顯著輕微的,依照治安管理處罰條例有關(guān)規(guī)定予以處罰。
Article 41 If a person steals or plunders mineral products or other property
of mining enterprises or exploration units, damages mining or exploration
facilities, or disrupts order in production and other work in mining areas or
areas under exploration, he shall be investigated for criminal responsibility in
accordance with relevant provisions of the Criminal Law; if the case is
obviously minor, he shall be punished in accordance with relevant provisions of
the Regulations on Administrative Penalties for Public Security.
第四十二條 買賣、出租或者以其他形式轉(zhuǎn)讓礦產(chǎn)資源的,沒(méi)收違法所得,予以罰款。
Article 42 If a person purchases, sells or leases mineral resources or
transfers them by other means, his unlawful proceeds shall be confiscated and he
shall be fined.
違反本法第六條的規(guī)定將探礦權(quán)、采礦權(quán)倒賣牟利的,吊銷勘查許可證、采礦許可證,沒(méi)收違法所得,處以罰款。
If a person, in violation of the provisions of Article 6 of this Law,
profiteers in exploration right or mining right, his exploration or mining
license shall be revoked and his unlawful proceeds confiscated, and he shall be
fined.
第四十三條
違反本法規(guī)定收購(gòu)和銷售國(guó)家統(tǒng)一收購(gòu)的礦產(chǎn)品的,沒(méi)收礦產(chǎn)品和違法所得,可以并處罰款;情節(jié)嚴(yán)重的,依照刑法第一百一十七條、第一百一十八條的規(guī)定,追究刑事責(zé)任。
Article 43 If a person, in violation of the provisions of this Law, purchases
or sells mineral products which are to be purchased exclusively by the State,
such products and his unlawful proceeds shall be confiscated, and he may also be
fined. If the case is serious, criminal responsibility shall be investigated in
accordance with the provisions of Articles 117 and 118 of the Criminal Law.
第四十四條
違反本法規(guī)定,采取破壞性的開采方法開采礦產(chǎn)資源的,處以罰款,可以吊銷采礦許可證;造成礦產(chǎn)資源嚴(yán)重破壞的,依照刑法第一百五十六條的規(guī)定對(duì)直接責(zé)任人追究刑事責(zé)任。
Article 44 If a person, in violation of the provisions of this Law, mines
mineral resources in a destructive way, he shall be fined and his mining license
may be revoked; if serious damage is caused to the mineral resources, the person
who are directly responsible shall be investigated for criminal responsibility
in accordance with the provisions of Article 156 of the Criminal Law.
第四十五條 本法第三十九條、第四十條、第四十二條規(guī)定的行政處罰,由縣級(jí)以上人民政府負(fù)責(zé)地質(zhì)礦產(chǎn)管理工作的部門按照國(guó)務(wù)院地質(zhì)礦產(chǎn)主管部門規(guī)定的權(quán)限決定。
Article 45 The administrative penalties prescribed in Articles 39, 40 and 42
of this Law shall be meted out by the department in charge of geology and
mineral resources under the people's government at or above the county level in
accordance with the limits of authority stipulated by the department in charge
of geology and mineral resources under the State Council.
第四十三條規(guī)定的行政處罰,由縣級(jí)以上人民政府工商行政管理部門決定。
The administrative penalties prescribed in Article 43 shall be meted out by
the administrative department for industry and commerce under the people's
government at or above the county level.
第四十四條規(guī)定的行政處罰,由省、自治區(qū)、直轄市人民政府地質(zhì)礦產(chǎn)主管部門決定。給予吊銷勘查許可證或者采礦許可證處罰的,須由原發(fā)證機(jī)關(guān)決定。
The administrative penalties prescribed in Article 44 shall be meted out by
the department in charge of geology and mineral resources under the people's
government of a province, autonomous region or municipality directly under the
Central Government. The punishment of revoking the exploration or mining license
shall be decided by the department that issued such licenses.
依照第三十九條、第四十條、第四十二條、第四十四條規(guī)定應(yīng)當(dāng)給予行政處罰而不給予行政處罰的,上級(jí)人民政府地質(zhì)礦產(chǎn)主管部門有權(quán)責(zé)令改正或者直接給予行政處罰。
If a department fails to impose administrative penalties that should be
imposed in accordance with the provisions of Article 39, 40, 42 or 44, the
department in charge of geology and mineral resources under the people's
government at a higher level shall have the authority to order a correction of
such failure or impose the relevant administrative penalties directly by itself.
第四十六條 當(dāng)事人對(duì)行政處罰決定不服的,可以依法申請(qǐng)復(fù)議,也可以依法直接向人民法院起訴。
Article 46 If a party refuses to accept the decision on administrative
penalty, it may, in accordance with law, apply for reconsideration or file a
suit with the People's Court directly.
當(dāng)事人逾期不申請(qǐng)復(fù)議也不向人民法院起訴,又不履行處罰決定的,由作出處罰決定的機(jī)關(guān)申請(qǐng)人民法院強(qiáng)制執(zhí)行。
If a party, within the time limit neither applies for reconsideration nor
files a suit with the People's Court, or complies with the decision on
punishment, the department that made the decision shall request the People's
Court to enforce the decision.
第四十七條
負(fù)責(zé)礦產(chǎn)資源勘查、開采監(jiān)督管理工作的國(guó)家工作人員和其他有關(guān)國(guó)家工作人員徇私舞弊、濫用職權(quán)或者玩忽職守,違反本法規(guī)定批準(zhǔn)勘查、開采礦產(chǎn)資源和頒發(fā)勘查許可證、采礦許可證,或者對(duì)違法采礦行為不依法予以制止、處罰、構(gòu)成犯罪的,依法追究刑事責(zé)任;不構(gòu)成犯罪的,給予行政處分。違法頒發(fā)的勘查許可證、采礦許可證,上級(jí)人民政府地質(zhì)礦產(chǎn)主管部門有權(quán)予以撤銷。
Article 47 State functionaries in charge of supervision and administration of
exploration and mining of mineral resources or other relevant State
functionaries who commit malpractices for personal gain, abuse their power or
neglect their duties, approve exploration and mining of mineral resources or
issue exploration or mining licenses, in violation of this Law, or does not stop
illegal mining activities and punish illegal miners, which constitutes a crime,
shall be investigated for criminal responsibility; if their acts do not
constitute a crime, administrative penalties shall be given. The department in
charge of geology and mineral resources under the people's government at a
higher level shall have the authority to revoke the exploration and mining
licenses illegally issued.
第四十八條
以暴力、威脅方法阻礙從事礦產(chǎn)資源勘查、開采監(jiān)督管理工作的國(guó)家工作人員依法執(zhí)行職務(wù)的,依照刑法第一百五十七條的規(guī)定追究刑事責(zé)任;拒絕、阻礙從事礦產(chǎn)資源勘查開采監(jiān)督管理工作的國(guó)家工作人員依法執(zhí)行職務(wù)未使用暴力、威脅方法的,由公安機(jī)關(guān)依照治安管理處罰條例的規(guī)定處罰。
Article 48 If anyone resorts to violence or intimidation when obstructing
State functionaries engaged in supervision and administration of exploration and
mining of mineral resources from performing their duties according to law, he
shall be investigated for criminal responsibility in accordance with the
provisions of Article 157 of the Criminal Law. If he does not resort to violence
or intimidation when obstructing State functionaries engaged in supervision and
administration of exploration and mining of mineral resources from performing
their duties according to law, he shall be punished in accordance with relevant
provisions of the Regulations on Administrative Penalties for Public Security.
第四十九條
礦山企業(yè)之間的礦區(qū)范圍的爭(zhēng)議,由當(dāng)事人協(xié)商解決,協(xié)調(diào)不成的,由有關(guān)縣級(jí)以上地方人民政府根據(jù)依法核定的礦區(qū)范圍處理;跨省、自治區(qū)、直轄市的礦區(qū)范圍的爭(zhēng)議,由有關(guān)省、自治區(qū)、直轄市人民政府協(xié)商解決,協(xié)商不成的,由國(guó)務(wù)院處理。
Article 49 Disputes over the limits of mining areas between mining enterprises
shall be settled by the parties involved through consultation; if consultation
fails, the relevant local people's government at or above the county level shall
handle the matter on the basis of the limits that are verified and fixed
according to law. Disputes over the limits of mining areas that straddle
provinces, autonomous regions, or municipalities directly under the Central
Government shall be settled by the people's governments of the relevant
provinces, autonomous regions or municipalities directly under the Central
Government through consultation. If consultation fails, the disputes shall be
settled by the State Council.
第七章 附 則
CHAPTER VII SUPPLEMENTARY PROVISIONS
第五十條 外商投資勘查、開采礦產(chǎn)資源,法律、行政法規(guī)另有規(guī)定的,從其規(guī)定。
Article 50 Where laws or administrative rules and regulations provide
otherwise on foreign-funded exploration and mining of mineral resources, such
provisions shall prevail.
第五十一條 本法施行以前,未辦理批準(zhǔn)手續(xù)、未劃定礦區(qū)范圍、未取得采礦許可證開采礦產(chǎn)資源的,應(yīng)當(dāng)依照本法有關(guān)規(guī)定申請(qǐng)補(bǔ)辦手續(xù)。
Article 51 Before this Law goes into effect, anyone who mined mineral
resources without going through approval procedures, without having the mining
area delimited and without obtaining a mining license shall apply for completion
of the formalities in accordance with relevant provisions of this Law.
第五十二條 本法實(shí)施細(xì)則由國(guó)務(wù)院制定。
Article 52 Specific rules for the implementation of this Law shall be
formulated by the State Council.
